Conhecimentos tradicionais na Amazônia : uma análise da capacidade protetiva das ações normativas e estatais

Abstract

This research aims to analyze, research and foster ways to improve the normative protections, conferred by the state apparatus, aimed at protecting biodiversity, as well as the traditional knowledge of the indigenous peoples of Amazonas, associated with it. The motivating elements of such studies came from the recurrence with which bioproducts, fruited over centuries of intergenerational transmissions by the indigenous peoples of Amazonas, are captured, usurped and exploited unilaterally, without any consideration to the original mentors. It is known that, in order to safeguard such biological wealth and socio-legal pluralities, rules of international, national and regional scope have been implemented. However, in order to make the protection and protection of the biological and intellectual treasures of the Amazon factually effective, the continuous improvement of the norms directly linked to the subject on screen becomes imperative. In this way, this research aims to study with a critical eye the legal-normative scope of the norm to its addressee, with a focus on proposing improvements that make it capable of effectively providing security to the traditional knowledge of the indigenous peoples of Amazonas, as well as to the genetic integrity of biodiversity
