Razão ambiental do direito à terra na Amazônia: dilemas da ordenação fundiária na ALAP BR-319

Abstract

This study was dedicated to the theoretical and reflective research environmental reason present in land rights in the Amazon, taking for granted the analysis of geopolitical actions in territorial processes of social and environmental inequality in the Amazon region, based on poverty boards, inequality and undercitizenship. Two projections of environmental rationales shape the scenarios of possible environmental tragedies, an instrumental character and other ethical-moral pretense. The political-ideological struggle for the use of environmental rationality in their ethics and instrumental aspects will be clarified during this study that takes as emblematic case of territorial planning attempts ALAP (area of provisional administrative limitation) the BR 319 by creating units Conservation, placing the enigmatic condition that Amazon took on his occupation and territorial development process, once participant a rationalizing modernity, now elected the sustainability pathos. The setting of the new order of rationalization and environmental institutionalization takes its greatest challenge facing land ordination dilemmas, considering the hybrid condition of the land (public and private) in their protected areas. The land, the congruence of environmental reason uti possidetis, demand the formation of new subjectivities and involves the construction of a subject (collective?) Law that opposes the idea of heritage as a constitution of the self-individual.
