Compras Públicas (In)Sustentáveis: estudo de caso na Secretaria Municipal de Meio Ambiente e Sustentabilidade de Manaus

Abstract

The understanding that natural resources are finite is encouraging important changes in behavior. In this context, there is a strong movement to encourage public procurement to incorporate sustainability criteria in bidding. However, there is also resistance from the agents involved in the incorporation of these criteria. In Brazil, the amendment of Article 3 of Law 8,666/93 and, more recently, the advent of the new Bidding Law (14,133/2021) established the regulatory framework that ensures that a bidding process has purposes that go beyond contracting with the lowest price. That is, procurement becomes a tool for development. This dissertation analyzes the incorporation of sustainability criteria in the processes of acquisition of goods and services by the Municipal Secretariat for Environment and Sustainability (SEMMAS) of Manaus. The research analyzed whether the processes of acquisition of goods and services carried out between 2018 and 2020 by SEMMAS incorporated sustainability criteria described in the Normative Instruction 01/2010 SLTI/MPOG, which provides for the criteria of environmental sustainability in the acquisition of goods, contracting of services or works by the Federal Public Administration. Based on the presence of these criteria in the bid invitations, scores were established to evaluate the evolution of sustainability criteria in SEMMAS' bidding processes. The results show that the presence of sustainability requirements and criteria in the public procurement processes of SEMMAS is still very low, even though it is an agency dedicated to promoting environmental policy.
