Mediação de conflitos familiares : uma análise da atuação interdisciplinar e a reincidência de usuários no CEJUSC em Manaus

Abstract

The starting point of the research analysis takes place through the social relations that are built in the capitalist society and that dictate the totality of the individuals' social life. Thus, it triggers the judicialization of life and when it reaches the family level, it is up to justice to promote alternatives for the resolution of conflicts. Professional performance in family mediation and family conflicts are the focus of this study. The objective of the research concerns the analysis of the performance of professionals in the mediation of family conflicts and the recurrence of users at CEJUSC in Manaus. The study aimed to see the problem from a perspective of totality, realizing the contradictions in reality and how family conflicts have an intrinsic relationship with the unfolding of the expressions of the social issue. This is a social research, which carried out a fruitful reading of the data collected in documentary and bibliographic research, as well as the data collected in field research with the participating actors in the research at the following locus: Centro Judiciário de Solução de Conflitos e Cidadania – CEJUSC - Polo Avançado Manaus. Its social relevance is to promote the expansion of facilitated access to justice, effectively and quickly through the mediation of family conflicts and results in actions that aim to meet the best interests of the subjects involved, ensuring the physical and psychosocial integrity of children and adolescents inserted in the process. Regarding the academic/scientific relevance, the study points to an expansion of the debate on the professional practice of social workers in family mediation in Amazonas. Among the results obtained with the research demonstrate that through mediation access to justice has expanded to the poorest populations, in addition to recognizing its importance in resolving family conflicts. There are also several socioeconomic and emotional factors that contribute to the non-fulfilment of agreements, with the need for Social Work professionals. Family mediation encounters barriers in its performance when conflicts present a high degree of complexity.
