A prescrição do auto de infração na governança ambiental no estado do Acre

The exploitation of natural resources increases as Society develops, and with it environmental degradation intensifies, putting presente and future generations at risk. As a resul of environmental degradation, natural resources, such as fauna and flora, are disappearing, the climate is changing, social inequalities are intensifying and conflicts over the use of resources. Among the degradation-inducing processes, deforedtation is one of the biggest today, as a result of anthropization, resulting from áreas destined for agriculture, the construction of hydroelectric dams, mining and repercussions. For these reasons, reducing deforestation is a maior challenge. According to the World Forest Observatory, deforestation reached about 29.7 million hectares worldwide in 2016. In 2018, according to Global Forest Watch, 12 million hectares of tropical forests were deforested. The list of countries that most deforested is led by Brazil, mainly in the Amazon Biome, followed by the Democratic Republic of Congo, Indonesia, Colombia and Malaysia. INPE reported that in 2019, deforestation increased by 278%, in the month of July, compared to July of the previous year, in 2020 deforestation totaled 1,499 square kilometers. The year 2021, the Legal Amazon Deforestation Bulletin – SAD, detected 1,606 square kilometers of deforestation in the Amazon, an increase of 7% compared to 2020, in October 2021 877 square kilometers, a record in the historical series of deforestation in the Amazon. Legal Amazon. (INPE, 2021). The removal of vegetation cover in the Amazon, the region with the greatest biodiversity on the planet, has caused worldwide concern. Although several procedures have been used to combat illegal deforestation, it is clear that even with the increase in efforts to protect the Amazon forest, explicit in the increase in infraction notices issued and in the amount of pecuniary sanctions, the results have indicated low effectiveness. of law enforcement. Given this scenario, the present work, which is entitled: "THE PRESCRIPTION OF THE NOTICE OF INFRINGEMENT IN THE ENVIRONMENTAL GOVERNANCE IN THE STATE OF ACRE.", aims to analyze the administrative procedures of IBAMA for the collection of fines for environmental crimes committed against the Amazonian flora, in the state of Acre, verifying its responsibility for the prescription of infraction notices in the period from 2013 to 2017. To this end, it is intended to develop a document analysis research of a quantitative-quantitative nature and at the end of the research to propose a financial recovery program of environmental fines. Thus, it is expected that this work and the suggestions that will be proposed, can contribute to the elaboration and evaluation of instruments, strategies and public policies for the protection of the natural resources of the Amazon Forest.
