Resumo

This research, focusing on the characteristics of the institutional environment of restrictive of freedom and private units for adolescents who committed infractions, analyze the influence of these units in relation to socioeducation provided for in the Statute of the Child and Adolescent (ECA) process. We note from the scientific literature and data from surveys and public reports, which sometimes these institutional environments are characterized by disciplinary methods and biopower, including disproportionate punishments, ranging from the deprivation of leisure, health care and objects for personal hygiene to physical violence, among others. For data analysis we used a dual theoretical perspective, consisting of Donald Winnicott's psychoanalysis and philosophy of Michel Foucault. In relation to Winnicott's theory, we concentrate mainly on the notions of good enough environment and antisocial tendency, from an inter-human perspective. As for Foucault's philosophy, we turn to the description about the power, surveillance and disciplining, employees in prisons devices, beyond the notion of biopower. Whereas the characteristics of the institutional environment, which make up the daily life of inpatient units, are of fundamental importance for the success or failure of socioeducation recommended in ACE established the following specific objectives: describe the characteristics of private and restrictive units of freedom of the childcare system in the Manaus from public data; analyze the characteristics of the restrictive and private units of freedom of the childcare system in Manaus based on the theories of Winnicott and Foucault; compose an overall view of the institutional routine impasses identified in our analysis, proposing suggestions. We hypothesized that the type of relationship established in the context of units of restrictive and custodial system of childcare, by not taking into account the extent necessary, the crucial importance of the establishment of an enabling environment, as conceived by Winnicott, as major axis of the institution, but disciplinary methods, surveillance, control, punishment and biopower, described by Foucault, is one of the main factors that impact decisively the success of socio proposal and the therapeutic management of antisocial conduct.
