As mulheres nas carreiras jurídicas no país dos bacharéis: avanços e desafios de advogadas e magistradas no Estado do Amazonas

Resumo

This research was based on an interdisciplinary theoretical-methodological reflection on gender and legal profession in the Amazon, especially in the city of Manaus-AM, at the time that the law course became the most popular in Brazil, with women in greater numbers. enrollment and graduates. They also advance in OAB registration number throughout Brazil, in all regions. This fine-tuning of the educational system and the world of work has guided us to the purposeful approach of the research entitled Women in Legal Careers in the Country of Bachelors: Advances and Challenges for Lawyers and Magistrates in the State of Amazonas. We draw on the analytical support of Bonelli, Bourdieu, Foucault, Scott and Morin's complex thinking, among others. The objective of the research was to understand how the female presence in legal careers, with a focus on law and the judiciary, promotes influences on their professionalism and the repercussions of their actions in the family and legal field. The practice of law, a liberal career from a private perspective, should be based on mutual trust between the lawyer and the clientele. The judiciary is a public career composed of members of the judiciary, which holds high decision-making power. The space cut refers particularly to the city of Manaus, where lawyers and magistrates reside and practice their profession; but without failing to involve comments on national and international dimensions covering the relationship between gender and legal professions. The time frame has prioritized the contemporary examination of female participation in advocacy, based on the dissemination of data from the 2015 national OAB on the quantitative by gender included in its framework; in the judiciary, based on 2014 data from the National Council of Justice and Regional Courts. The central thesis states that, in the exercise of their profession, lawyers and judges are still confronted with gender discrimination, regarding the macho treatment by their peers as remnants of the patriarchal system, even though law is no longer a predominantly profession today. Men only. These professions remain particularly masculine, when it is found that the performance of these professionals in legal areas that require less impromptu hours, such as Family Law, Labor Law, Consumer Law, among others, allows the lawyer to reconcile her family agenda with the changes in the world of work and in the productive sphere that demand from women a multiplicity of different social roles that give rise to techniques and skills, values and social attitudes.
