Dos que flecham longe: o protocolo de consulta e consentimento Wajãpi

Resumo

This dissertation is the result of research that focused on the Wajãpi Consultation and Consent Protocol as a modality they developed to establish criteria and parameters for their relationships with non-Indians in order to control their agency and eventually domesticate them in order to to establish the ways for this agency to result in public policies that ensure the essential conditions for the maintenance of their ways of living. The Wajãpi of Amapari, Amapá, were the first indigenous people in Brazil to implement a Protocol of Consultation and Consent. This instrument, provided for in Convention 169 of the International Labor Organization, ILO, aims to establish parameters for its participation in the decisions of the Brazilian State in order to safeguard its rights to self-determination and self-management through, among other things, prior, free consultation. informed, in good faith and culturally appropriate, which is guaranteed by Convention 169. The Wajãpi Consultation Protocol is an instrument developed by the group to ensure conditions for the perpetuation of its relationship modalities and knowledge regimes as it consists of a formalization exercise minimum conditions for the maintenance of their relationship regimes, with the environments and their owners, but at the same time, it also establishes criteria for the relationship with non-Indians, stipulating, based on an etiology of non-Indians, minimum parameters of behavior to be followed by them. Using a long and in-depth study of non-Indians, based on readings of the myths of origin and on the narratives of episodes dated to the time of grandparents (in which reports from ancestors help to shape the etiological profile of non-Indians), the Wajãpi formalized, with the Protocol, an exercise carried out for many decades to establish mechanisms to stop the influence of non-Indians in their decisions and in their daily life, safeguarding their autonomy and their daily knowledge. Thus, the Wajãpi Consultation Protocol is the result of a group effort to establish collective modalities of collective management, in the first instance and, furthermore, of collective management of non-Indians. The case of the Friendship Band, the first application of prior consultation under a Protocol, illustrates this movement of domestication and agency of non-Indians.
