Constelação familiar e sociologia processual: o direito sistêmico para a solução de conflitos no Amazonas

Abstract

This dissertation entitled "Family Constellation and Procedural Sociology: the Systemic Law for the solution of conflicts in the Amazon"brings the basis of the theory of the sociologist Norbert Elias on the concepts of figuration and interdependence to discuss the Family Constellation of the philosopher and therapist Bert Hellinger. The work presents the use of Systemic Law and the Family Constellation as a consensual method of conflict resolution in the Brazilian judiciary. The objective of the work is to identify the connection between the theories of Elias and Hellinger and the Systemic Law which expands throughout the national territory with the use of the Family Constellation as a support tool in the operationalization of the judiciary. The methodological procedure used is theoretical, hypothetical-deductive, qualitative research, primary and secondary sources. With the research on the intersection between the theories of Elias and Hellinger and the expansion of Systemic Law through the practice of the Family Constellation in the Brazilian judiciary it was possible to recognize which scenario is more favorable for the use of the Family constellation for conflict resolution in both Brazil and the Amazon. Given that the State of Amazonas has peculiarities regarding access to inland municipalities and still shy expression as the practice of the Family Constellation in the Amazonian judiciary although, the example of the other Courts of Justice of Brazil exist the implementation of projects aimed at the use of the Family Constellation as a consensual method of conflict resolution making emerge new possibilities to understand the context of conflicts bringing solutions that give relief to all involved.
